国家队运动员身份混同引发的法律问题及其治理思考

摘　　要：近年来,随着社会经济的不断发展,国家队运动员身份发生了重大变迁,产生了身份混同的问题,进而可能导致对身份法律性质的认识谬误、多重身份规范适用冲突以及身份规范与利益的双重博弈等诸多法律问题。运用文献分析的方法,结合国家队队员的固有特征提出相关治理建议,以期为完善我国体育纠纷解决机制和落实保障运动员合法身份权益提供相关建议。具体来说,应坚持确立身份规则这一出发点和落脚点,在此基础上明确国家队运动员身份权利的内容及边界、试行运动员商业开发活动招标制度、加强国家队运动员身份认同感、签订差异化的国家队选拔协议、健全法律机制以此完善身份救济。以“身”定“份”的观点为解决国家队运动员身份混同问题提供了新的理论视角。因此,建议在实践中积极探索以“身”定“份”的治理方式,以更好地维护国家队运动员的权益,促进体育产业的健康发展。In recent years,with the continuous development of social economy,athletes on national team have witnessed significant changes in their identity,which resulted in their identity confusion,leading to many legal issues such as misconceptions about the legal nature of identity,conflicts in the application of multiple identity norms,and the dual game between identity norms and interests.In view of this phenomenon,relevant suggestions on how to solve this problem are proposed based on the inherent characteristics of national team athletes by literature analysis,in order to dedicate suggestions to improving dispute resolution mechanism of China’s sports and to the protection of the legitimate identity rights and interests of athletes.Specifically,identity rules should be established as the core,based on which,the content and boundaries of the identity rights of athletes on national team should be clarified,a bidding and tendering system for commercial development activities for athletes should be piloted,and the sense of identity identification of national team athletes should be strengthened.The viewpoint of determining rights in accordance with identity provides a new theoretical perspective for solving this problem among national team athletes.Therefore,it is recommended to proactively explore methods for settlement in accordance with identity in practice,so as to better safeguard the rights and interests of national team athletes and promote the healthy development of sports industry.
