遏制跨境寄递毒品走私的涉外法治建设研究

摘　　要：近年来,跨境寄递走私毒品案件屡见不鲜,成为走私毒品新兴途径。跨境寄递毒品所具有的隐蔽性、低消耗性、境内外牵连性、网上网下交织性等特征促使该类犯罪高发,通过现代化网络平台开展跨境寄递,降低了贩毒“准入”的成本,已有的链接境内外犯罪人员的犯罪生态链加剧了案件的复杂程度,增加了公安机关对该类犯罪的打击难度。各国在打击跨境寄递毒品走私的过程中存在着查验难、管辖权限不清、调查取证不便等问题,打击跨境寄递毒品的法律规范缺位、合作体制难以确立、缺乏政治互信等现状使得国际警务执法合作存在困难。因此,通过完善国内法的域外适用,加强双边、多边警务合作等角度建立健全遏制跨境寄递毒品犯罪的涉外法治体系,在此基础上构建全方位、多层次、信息化、高效率的打击跨境寄递毒品合作机制成为解决当前问题的必由之路。Cross-border delivery of smuggled drugs is not uncommon,and the characteristics of cross-border delivery of drugs,such as concealment,low consumption,domestic and foreign involvement,and interweaving online and offline,have aggravated the frequency of such crimes.The combination of modern network platforms and cross-border delivery has also made drug trafficking easier to"enter",which has formed a criminal ecological chain linking criminals at home and abroad,making it more difficult to crack down on such crimes.However,there are still some problems in the process of cracking down on cross-border drug smuggling,such as difficulty in inspection,unclear jurisdiction,inconvenience in investigation and evidence collection,etc.The current situation of cracking down on cross-border drug smuggling,the lack of legal norms,the difficulty in establishing a cooperation system,and the lack of political mutual trust make international police law enforcement cooperation difficult.It is the only way to solve the current problem to establish and improve the legal system to curb cross-border drug delivery crimes from the international,national,and individual levels,such as improving the extraterritorial application of domestic laws,strengthening bilateral and multilateral police cooperation,and building an all-round,multilevel,informationbased and efficient cooperation mechanism to combat cross-border drug delivery.
