数额特别巨大型受贿罪量刑失衡问题实证研究

摘  要:受贿数额较大、巨大以及特别巨大分别对应受贿罪三档刑罚,对1088份受贿数额特别巨大型受贿罪判决书实证研究发现,在第三档刑罚中存在量刑轻缓化、数额与刑期对应的跨度过大等量刑失衡问题。在该档刑罚中,从宽情节与从严情节适用失衡。从宽情节突破了数额对量刑的限制,因此量刑失衡问题根源在于数额“失守”与从严情节“失灵”。为实现量刑均衡,应明确“数额+情节”并重的复合量刑模式在第三档刑罚中的适用,即以数额明确最低适用刑期,发挥从严情节作用,细化数额特别巨大标准,明确数额区间对应的最低刑期,解释从严情节成立与加重的判断标准,分类从宽情节,精细化规范从宽效果。Large amount,huge amount and extremely huge amount decide the criteria for imposing penalty in the crime of taking bribes.According to the empirical study of 1088 court verdicts involving bribery of extremely huge amount,the imbalance in sentences can be found in forms of underpunishment or improper term of imprisonment in accordance with the bribery amount.In the case of extremely huge amount,circumstances for leniency and severe punishment are inappropriately used.For leniency is abused and undermines the criteria for penalty,the root cause of the imbalance is the negligence of bribery amount and failure of severe punishment.Therefore,the compound penalty pattern of“bribery amount+sentencing circumstances”should be considered in the case of extremely huge amount.In other words,the bribery amount should decide the minimum penalty to perform the effect of severe punishment.The scale of extremely huge amount should be further specified to identify the relevant minimum penalty.The circumstances of severe punishment should be interpreted,and the circumstances of leniency be classified to regulate their application.
