论我国构建知识产权纠纷多元化解决机制的挑战及建议

摘　　要：我国知识产权纠纷案件数量逐年激增,客观上对我国的司法体系造成一定负担。解决问题的出路在于构建多元化的知识产权纠纷替代性解决机制,即仲裁与调解。首先,在我国现有法律框架下,知识产权纠纷可仲裁的范围有限,实践上亦不统一,因此需要推动完善知识产权仲裁立法,明确扩充知识产权可仲裁范围。其次,建议借鉴世界知识产权仲裁的先进经验,构建知识产权纠纷合并仲裁与快速仲裁制度,引入仲裁专家裁定制度。最后,由于实践中知识产权纠纷的仲裁与调解之间相互衔接配合情况并不理想,因此需要通过立法构建衔接调解与仲裁的知识产权纠纷临时仲裁制度,以及构建仲裁介入“司法诉前联调”渠道。此外,知识产权仲裁与行政处理的对接机制也亟待探索构建。With the number of intellectual property disputes in China increasing year by year,the judicial system has been overwhelmed.The solution to this problem can only lie in the construction of a diversified alternative dispute resolution mechanism for intellectual property disputes,namely arbitration and mediation.Under the existing legal framework in China,the scope of arbitrable intellectual property disputes is limited,and practice is also not uniform.Therefore,it is necessary to promote the improvement of intellectual property arbitration legislation,clarify the expansion of intellectual property arbitrable scope.It is also recommended to draw on advanced experience in intellectual property arbitration in the world,construct a merger and rapid arbitration system for intellectual property disputes,and introduce an arbitration expert ruling system.In addition,the docking and coordination between arbitration and mediation of intellectual property disputes is not ideal.Therefore,it is necessary to construct a temporary arbitration system for intellectual property disputes through legislation,which integrates mediation and arbitration;build channels for judicial pre-trial mediation and arbitration.At the same time,the construction of a docking mechanism between intellectual property arbitration and administrative handling is also worth exploring.
