摘 要:企业行政合规的发展得益于优化营商环境与政府服务理念的转变。我国现阶段对企业的行政监管仍以合法行政为主要目标,但是企业行政合规应当体现出“最佳行政”的理念。我国企业行政合规体系正处于建构初期,存在规范供给不足、企业合规动力欠缺等困境。为此,有必要以“强制”的方式实现企业行政合规建设的突破,通过建立有针对性的行政和解制度,全面引入行政和解协议,对企业形成有效的合规激励。The development of corporate administrative compliance benefits from the optimization of the business environment and the transformation of the concept of government services.At present,the administrative supervision over enterprises in our country is primarily aimed at ensuring legal compliance,however the administrative compliance over enterprises should embody the concept of the optimal administration.China's corporate administrative compliance system is still in the early stage of construction,and there are many difficulties such as insufficient supply of regulations and lack of compliance motivation.To this end,it is necessary to achieve a breakthrough in the construction of corporate administrative compliance in a"compulsory"way,by establishing a seductive and targeted administrative reconciliation system and comprehensively introducing administrative reconciliation agreements to form an effective compliance incentive for enterprises.
