我国应急征用补偿制度的现实困境及优化路径

摘　　要：风险社会下各类突发事件频发,影响着我国正常的社会秩序,阻碍社会经济的可持续发展。在处置突发事件的过程中,我国应急征用补偿制度所展现的及时、有效等优势受到社会的广泛认可,但我国应急征用补偿制度存在征用决定主体及范围不明确、补偿主体不确定、补偿范围有限且标准模糊以及应急征用补偿程序性规定不健全等问题,致使在实践中存在征用主体履行相关义务不及时、被征用主体救济渠道不畅通等问题。通过明确应急征用决定主体及范围、规范补偿主体、确定征用补偿标准并有序拓展补偿范围、优化应急征用补偿程序,完善我国突发事件应急征用补偿制度的法律依据,进一步拓宽被征用主体的权利救济渠道等,以期能为完善我国突发事件征用补偿制度,有效应对各类突发事件、维护社会秩序与经济发展有所增益。The emergence of numerous emergencies on a regular basis in a risk society disrupts our country′s normal social order and impedes the social economy′s long-term development.In the process of dealing with emergencies,China′s emergency expropriation compensation system has been widely recognized by society for its timely and effective advantages;however,China′s emergency expropriation compensation system has problems such as unclear subject and scope of expropriation decision,uncertainty of compensation subject,limited scope and vague standards,and imperfect procedural provisions for emergency expropriation compensation,resulting in problems such as untimely performance of relevant obligations by administrative entities and unsmooth relief channels for counterparties in practice.By clarifying the subject and scope of emergency expropriation decisions,standardizing the compensation subjects,determining the compensation standards for expropriation,expanding the scope of compensation in an orderly manner,and optimizing the compensation procedures for emergency expropriation,the legal basis of China′s emergency expropriation compensation system is improved,and the performance of the relevant obligations of administrative entities is guided in practice,and the improvement of the remedial channels for the rights of compensation counterparts is improved,so as to improve China′s emergency expropriation compensation system,effectively respond to various emergencies,and maintain social order and economic development.
