摘 要:本研究旨在研究常规育种中的知识产权管理与法律问题,深入分析了专利权、植物品种权等知识产权形式在育种活动中的应用,以及国际法规、国内法律框架对常规育种的影响。探讨了专利申请与保护、植物品种权管理、商业秘密保护等关键问题,并指出了在生物多样性与知识共享、种子自由与农民权益、跨国合作与知识产权纠纷等方面的挑战。对知识产权管理对可持续性发展的影响进行了探讨,强调了农业创新的重要性,提出了平衡知识产权与共享创新的方向。为未来升级完善法律框架、优化专利权保护机制、建立农业科技共享机制以及强化农业法律救济体系,促进农业领域的科技创新和可持续发展提供了理论依据。The aim of this study is to investigate intellectual property management and legal issues in conventional breeding,and to deeply analyze the application of intellectual property forms such as patent rights and plant variety rights in breeding activities,as well as the impact of international regulations and domestic legal frameworks on conventional breeding.Explored key issues such as patent application and protection,plant variety rights management,and trade secret protection,and pointed out challenges in biodiversity and knowledge sharing,seed freedom and farmer rights,cross-border cooperation,and intellectual property disputes.The impact of intellectual property management on sustainable development was discussed,emphasizing the importance of agricultural innovation and proposing a direction to balance intellectual property and shared innovation.This provides a theoretical basis for upgrading and improving the legal framework,optimizing patent protection mechanisms,establishing agricultural technology sharing mechanisms,and strengthening the agricultural legal relief system to promote technological innovation and sustainable development in the agricultural field in the future.
