摘　　要：品种保护法律制度为农业创新提供了法律框架和经济激励,从而促进了农业的可持续发展,保障了育种者的权益,提高了农产品的质量和市场竞争力。但其实施也引发了一系列关于农户自留种权的问题。市场垄断、法规执行和农民对新品种需求的制约成了当前亟待解决的难题。本研究深入探讨了在品种保护法律制度下涌现的农户自留种权问题,对品种保护法律制度的定义、范围、法规体系以及国际比较进行了详细阐述,着眼于农户自留种权,深刻剖析了其内涵、法律依据以及特殊性。本研究深入分析当前农户自留种权问题存在的挑战与争议,提出可能的解决方案与改进建议,旨在推动农业法制的进步,确保农业可持续发展与农民权益的平衡。The legal system for variety protection provides a legal framework and economic incentives for agricultural innovation,thereby promoting sustainable development of agriculture,safeguarding the rights and interests of breeders,and improving the quality and market competitiveness of agricultural products.But its implementation has also raised a series of issues regarding the right of farmers to retain their own seeds.Market monopolies,regulatory enforcement,and constraints on farmers'demand for new varieties have become urgent challenges that need to be addressed.This study delves into the issue of the right of farmers to retain their own seeds that has emerged under the legal system of variety protection.It provides a detailed explanation of the definition,scope,regulatory system,and international comparison of the legal system of variety protection,focusing on the right of farmers to retain their own seeds.It deeply analyzes its connotation,legal basis,and particularity.This study provides an in-depth analysis of the challenges and controversies in the current issue of farmers'self retention rights,and proposes possible solutions and improvement suggestions,aiming to promote the progress of agricultural legal system and ensure the balance between sustainable development of agriculture and the rights and interests of farmers.
