摘 要:从专利规避的概念和现实意义出发,介绍了专利规避的国内现状和发展情况。阐述了成功的专利规避需要具备的4项本质特征,以及对应的高、低两个实现程度。着重介绍了基于TRIZ的专利规避的4个主要实施步骤,具体解释说明了各步骤中可能用到的各种TRIZ工具。并且给出了一个吸入口止回阀的应用实例。最后对专利规避做了总结。本文结合了专利规避实际经验和业界研究成果,以期对技术开发中的知识产权开发及保护工作具有实战借鉴作用。Starting from the concept and realistic significance of patent around design,this article introduces the current situation and development of patent around design in China.description on the four essential features required for successful patent around design,as well as the corresponding high and low implementation levels.Emphasis was placed on introducing the four main steps of patent around design based on TRIZ,and specific TRIZ tools that may be used in each step were explained.An Intake Check Valve example was given to explain it’s application also.Finally,a summary was made on patent around design.This article combines experience in patent around design with industry research and development,with the aim of providing reference for intellectual property development and protection in technology research and development.
