摘　　要：在全面推进依法治国、强化社会保障法治的背景下,我国社会养老保险立法面临实践和理论的双重供给不足。推进社会养老保险立法,需注重以社会保险权为根本的法理渊源、以养老保险改革为基础的经济背景和以权利本位为导向的管理体制。文章以此建立分析框架,对主要国际组织的社会保障理念以及日本、韩国、美国、德国等典型国家社会养老保险中有关覆盖范围、筹资缴费、给付条件、待遇领取、待遇调整、司法救济的立法内容进行经验借鉴。未来我国社会养老保险立法应在兼顾全面性与统一性、稳定性与灵活性、原则性与实用性、规范性和精细化的基础上,持续完善养老保险制度整合及专项立法部署,推动社会保障法治现代化进程。Underthe background of comprehensively promoting the rule oflaw and the legalization of social security,China's social pension insurance legislation is faced with the double supply shortage of practice and theory.In order to promote the legislation of social pension insurance,it is necessary to focus on the legal source based on social insurance rights,the economic background based on pension insurance reform,and the management system oriented by rights protection.In this way,the paper establishes an analytical framework to learn from the social security concept of major international organizations and the legislative content of coverage,financing and payment,payment conditions,benefits receiving,benefits adjustment and judicial relief in Japan,South Korea,the United States,Germany and other typical countries.In the future,China's social pension insurance legislation should properly handle the relationship between comprehensiveness and unity,stability and flexibility,principle and practicality,standardization and refinement,and continue to promote the system integration and special legislation of social pension insurance.
