摘 要:以网约工为代表的新就业形态劳动者不同于传统灵活就业人员,面临平台经济高速发展催生的高频多发职业伤害风险。目前工伤保险制度未全覆盖此群体,试点中以延续劳动关系认定为核心的纳入工伤保险模式和工伤保险复合商业保险模式仍面临不可持续风险,超越劳动关系独立建制模式为理论突破提供新的研究取向。新发展格局下应保障全体公民实现社会保险权,网约工职业伤害保障制度构建也依此展开:即坚持社会保险属性并扩大试点,补齐职业伤害保障短板;以健全最低工资为前提规范制度参数设计,明确职业伤害风险权益保障责任;提升制度治理效能,优化职业风险服务保障;强化多方主体协同治理,完善保障工作机制,最终实现覆盖全体劳动者的多层次、有梯度、可持续的中国特色职业伤害保障体系。The new employment form workers represented by online workers are different from the traditional flexible employment workers,and they face the risk of multiple occupational injuries arising from the rapid development of platform economy.This group is not covered by the current work injury insurance system.In the pilot,the industrial injury insurance model and the industrial injury insurance composite commercial insurance model,which centered on the recognition of continued labor relations,are still facing unsustainable risks.Under the new development pattern,all citizens should be guaranteed the right to social insurance,and the construction of the occupational injury protection system for online workers should be carried out accordingly:adhere to the attributes of social insurance and expand pilots to fill up the shortcomings of occupational injury protection;Standardize the design of system parameters on the premise of improving the minimum wage,and clarify the protection of occupational injury risk rights and interests;Improve the efficiency of system governance and optimize the occupational risk service guarantee;Strengthen multi-stakeholder collaborative governance,improve the working mechanism,and finally realize a multilevel,gradient and sustainable occupational injury guarantee system with Chinese characteristics that covers all the people.
