摘 要:当前大数据概念的模糊不清是法学研究者在法律论证与学术论辩时面临的首要困境。大数据概念模糊的原因是大数据在不同视角下呈现出数据、信息、技术的多重面相,大数据的法学定位也应在此三层面进行考虑。互联网平台大数据的本质是信息的集合,其赋权基础在于平台对信息的价值添附。虽然大数据的原始生产者是数据的提供者,但是互联网平台通过对数据中信息的收集、整合、清理,使信息集合超越单个信息总和而产生了新的价值,由此互联网平台得以对此大数据享有权利。The current ambiguity surrounding the concept of big data has posed challenges to legal arguments and academic debates.The contention over the definition of big data arises from its multifaceted nature,encompassing aspects of data,information,and technology from various perspectives.The legal study positioning of big data should,therefore,be considered from these three dimensions.The essence of big data on internet platforms lies in the aggregation of information,and its empowerment is based on the platform’s value addition to this information.While the original producers of big data are the data providers,internet platforms,through the collection,integration,and refinement of information within the data,generate new value that transcends individual information sums.This serves as the foundation for granting internet platforms rights over big data.
