健身预付卡规制的创新路径:以合作规制为核心的多元治理模式

摘　　要：随着大众健康观念的转变,加之全民健身战略的支持,健身预付卡市场得到了快速发展,也浮现出诸多问题。在此情形下,传统行政规制的局限性愈发明显,难以实现切实有效的治理。分析健身预付卡的本质属性与存在风险,阐述传统行政规制的局限性与创新可能性,提出合作规制下的多元治理策略:明确健身预付卡风险防控的规制目标;搭建政府监管、行业自律、企业自治和消费者监督的合作共治网络;形成涵盖多元规制主体在内的复合规制责任体系;设立多样化的规制救济途径。With the change of the public health concept and the support of the national fitness strategy,the fitness prepaid card market has developed rapidly and many problems have emerged.The limitations of traditional administrative regulation are becoming more and more obvious,and it is difficult to realize effective and efficient governance.The paper analyzes the essential attributes and risks of prepaid fitness cards,explains the limitations and innovation possibilities of traditional administrative regulation,and proposes a multi-governance strategy under cooperative regulation,such as to clarify the regulatory objectives of risk prevention and control of prepaid fitness cards,to build a cooperative network of government regulation,industry self-regulation,corporate autonomy and consumer supervision,to form a composite regulatory responsibility system that covers the multi-regulatory subjects and to set up a diversified regulatory relief pathway.
