摘　　要：以协同概念的辨析与适用作为研究的逻辑起点,从完善立法权配置、最小化立法成本以及践行立法传承与立法国际化等3个方面展开协同立法必要性之证成。基于理论探索和实践考察两个层面,检视共同立法和合作协议区域协同立法模式,其中,低成本、高效率、重灵活的合作协议模式与协同理念高度契合,立法软化是城市群生态环境协同立法的适宜选择。从城市群生态环境合作协议的合宪性与合法性、法律效力、缔结主体以及利益衡量等维度进行论证,以期建立高效公平且具制度约束力的协同立法模式,为城市群生态环境共治提供法治样本。Taking discrimination and application of collaboration as a logical starting point,the thesis justifies the necessity of collaborative legislation from three aspects,i.e.,improving allocation of legislative power,minimizing legislative cost,inheriting and internationalizing legislation.Based on theoretical exploration and practice investigation,patterns of concurrent legislation and collaborative legislation between cooperative and agreed-upon regions are examined.The latter pattern,characteristic of low cost,high efficiency and flexibility,is in perfect harmony with the concept of collaboration.Softening of legislation is a suitable choice for eco-environmental collaborative legislation of urban agglomeration.The thesis expounds the constitutionality and legality,force of law,subjects and balancing of interest of eco-environmental cooperative agreements of urban agglomeration,in an effort to construct a collaborative legislation pattern with high efficiency,justice and institutional binding force,and provide a legal sample for eco-environmental cooperative governance of urban agglomeration.
