行政执法权下放中街道执法权行使的“围城困局”及其化解——基于武汉市的实地调研

摘　　要：随着《地方组织法》《行政处罚法》的相继修订,围绕执法权下放的街道综合行政执法体制改革已全面启动。但因过程中的目标理论、过程法理、资源机制等法治难题悬而未决,街道执法权行使中出现执法权力弱、执法依据缺、执法能效低、执法合力散等“围城困局”,致使执法疲软。建议构建顶层法治设计,以整体性治理理论为牵引,统一执法权下放的法理内涵、明晰执法权下放的合法基础、夯实执法权下放的合法路径、建构执法权下放的标准体系等过程法理之疏通与链接,保障街道执法主体地位的确立;并以规范化的制度建构与运行,如设立统筹协调机构、创新委托执法机制、健全资源配给机制、建立约束评价机制、优化资源嫁接机制等,巩固街道执法主体地位。With the revisions of the Local Organization Law and the Administrative Penalty Law,the reform of comprehensive administrative law enforcement system of sub-district office,centered on the decentralization of law enforcement power,has been fully launched.However,due to the unresolved legal issues such as goal theory,procedural jurisprudence,and resource mechanisms,the exercise of law enforcement power of sub-district office has encountered“siege dilemma”such as weak law enforcement power,lack of law enforcement basis,low energy efficiency of law enforcement,and scattered law enforcement forces.Therefore,it is recommended to construct a top-level rule of law design,guided by the theory of holistic governance,to unify the legal connotation of law enforcement decentralization,to clarify the legal basis of law enforcement decentralization,to consolidate the legal path of law enforcement decentralization,and to construct a standard system for law enforcement decentralization,so as to ensure the establishment of the principal status of sub-district office in law enforcement.Meanwhile,with standardized institutional construction and operation,such as establishing a coordinated organization,innovating entrusted law enforcement mechanisms,improving resource allocation mechanisms,establishing constraint evaluation mechanisms,optimizing resource grafting mechanisms,the principal status of sub-district office in law enforcement will be consolidated.
