摘　　要：在加强新时代法学教育大背景下,应当反思和改进我国法学院校本科刑法案例课程教学的传统模式。鉴定式案例分析方法特色鲜明,在思维模式、分析内容以及过程等方面有诸多可取之处,但其在我国的本土化实践并不顺利。无论是从理念、规范层面,还是政策、现实需求层面,借鉴并试行鉴定式案例分析方法均具有积极意义。因此,探索鉴定式案例分析方法的本土化路径是问题的关键。目前及将来一段时间,既不宜在我国全面推行鉴定式案例分析方法,也不应彻底排斥其适用,而应根据课程教学需要,在满足对象特定、模式固定、试行稳定三大前提下,继续将鉴定式案例分析方法作为传统裁判式案例分析方法的重要补充,试行中总结经验、逐步推进本土化进程。In the context of strengthening legal education in the new era,it is necessary to reflect on and improve the traditional mode of criminal law case courses teaching in undergraduate law schools in China.As a unique case analysis technique,the technique of the application of law through an expertise has obvious advantages in terms of thinking mode,analysis content and process,but its localization practice in China has not been smooth.However,it is undeniable that drawing on and piloting the technique of the application of law through an expertise still has positive significance,whether from the perspective of ideology,norms,policies,or practical needs.Therefore,exploring the localization path of the technique of the application of law through an expertise is the key to the problem.At present and in the future,it is not appropriate to fully promote the technique of the application of law through an expertise,nor should it be completely excluded from its application.Instead,according to the needs of curriculum teaching,under the premise of meeting the three major requirements of specific objects,fixed modes,and stable trial implementation,the technique of the application of law through an expertise should continue to be an important supplement to the traditional judgment style case analysis method,summarizing experience during trial implementation,and gradually promoting the localization process.
