法治视角下的交警追缉行为

摘　　要：交警追缉行为是交警对逃逸违法行为人进行追捕的具体行政行为。由于缺乏法律规范的明确指引,交警追缉经常面临一些问题。具体而言,在追缉行为的启动条件、适用方式以及善后处理等方面,存在着认定法律情节不准确、作出的法律决定不合理、对行政相对人合法权益造成损害等情形。由此,有必要对产生问题的根本原因进行分析,并在此基础上全面完善交警追缉行为的实施规则,从而引导交警依法合理开展追缉工作。The traffic police pursuit behavior is the specific administrative behavior of the traffic police to chase the fugitives.Due to the lack of clear guidance of legal norms,traffic police often face some problems in pursuit.Specifically,in terms of the starting conditions,application methods and after-treatment of the pursuit behavior,there are situations such as inaccurate identification of legal circumstances,unreasonable legal decisions,and damage to the legitimate rights and interests of the administrative counterpart.Therefore,it is necessary to analyze the root cause of the problem,and on this basis,comprehensively improve the implementation rules of the traffic police's pursuit behavior,so as to guide the police to carry out the pursuit work reasonably according to law.
