债务加入人追偿权的体系化证成与适用

摘　　要：基于在审判实务中维护法律适用统一的需要,《民法典合同编解释》第51条在《民法典》第552条基础上规定了债务加入人的追偿权。对此追偿权的分析需要在充分尊重当事人的意思自治、注重发挥债务加入制度功能的基础上,运用体系化适用、利益衡量等方法,准确理解《民法典》第519条关于连带债务的规定,明确相应的请求权基础。在具体适用时要遵循相应规范的构成要件依法行使,同时要平衡好对债务人利益的保护,避免对其造成不当损失。Based on the need to maintain the uniformity of legal application in judicial practice,Article 51 of the Interpretation of the General Principles of Contract stipulates the right of Contribution for debt joiner based on Article 552 of the Civil Code.The analysis of the right of Contribution needs to be based on fully respecting the autonomy of the parties involved and emphasizing the system function of the coexistence of debt,using systematic applications,interest measurement and other methods,accurately understanding the provisions of Article 519 of the Civil Code on joint and several obligations,and clarifying the corresponding basis for the right of claim.In specific applications,it is necessary to follow the constituent elements of corresponding norms and exercise them by the law,while balancing the protection of the debtor's interests and avoiding improper losses.
