科研单位使用外委开发软件的版权侵权风险与应对

摘　　要：科研单位将科研生产中用到的部分计算机软件委托外部专业供应商开发已成为趋势,但若不当使用外委开发的计算机软件,则存在一定的版权侵权风险。当供应商交付的计算机软件本身侵权、科研单位未取得相关权利而超越范围使用计算机软件或擅自允许其他主体使用计算机软件以及日常管理不当等情形均存在软件侵权风险。基于此,科研单位可以从外委开发软件的事前、事中和事后三个方面采取措施防控使用外委开发软件的版权侵权风险。It has become a trend for scientific research institutions to entrust some computer software used in scientific research and production to external professional suppliers for development,but if the computer software is improperly used,there is a certain risk of copyright infringement.Software infringement risks exist when the computer software delivered by the supplier itself infringes,the scientific research unit uses the computer software beyond the scope without obtaining relevant rights,or allows other entities to use the computer software without authorization,and improper daily management.Based on this,scientific research institutions can take measures to prevent and control the copyright infringement risk of using outsourced software from three aspects:before,during and after the outsourcing software development.
