苗族习惯在基层社会治理法治化中的当代价值

摘　　要：苗族传统文化长期积累的议榔、贾理、理老断案习惯,蕴含了丰富的社会治理价值和纠纷诉解工具价值,议榔、贾理、理老断案习惯的精神理念,包含有培育温情家庭邻里社会的伦理基础,补缺国家刚性司法不足的柔性调适作用,塑造个人人格行为模式的文化功能,促进民主和谐共生社会关系生成的社会机制。从价值分析的角度,许多价值对当下化解家庭邻里等基层社会矛盾纠纷,推动社会协调有机运行具有积极的价值,应当加以利用,与国家司法诉解纠纷互促互进,融通协调运行。在当代基层社会治理法治化的过程中,利用议榔、贾理、理老断案习惯,应当发挥好习惯的文化教育引导作用,为法治社会打下良好的道德伦理基础,用好习惯在法治留给社会自治空间中的规范调节作用,规避习惯的消极因素,使其在法治的引导下与时俱进。In the traditional culture of the Miao ethnic group,there are long-standing case-solving habits known as"Yi Lang,""Jia Li,"and"Li Lao"(in Miao language),which contain abundant values related to social governance and dispute resolution tools.Moreover,the spiritual concepts underlying these case-solving habits serve as an ethical foundation for fostering warm and loving families and neighboring communities,flexible adjustments to the state's rigid judiciary system,cultural functions in shaping individuals'behavioral patterns,and a social mechanism for promoting the formation of democratic,harmonious,and symbiotic social relationships.From a value analysis perspective,this article argues that given the aforementioned values'positive roles in resolving grassroots social disputes within families or between neighbors,as well as in fostering the harmonious and organic functioning of society,these case-solving habits should be utilized,advanced,as well as coordinated with the nation's dispute resolution relying on judicial litigation.In contemporary society where law-based social governance at the grassroots level is being strengthened,it becomes imperative to use these case-solving habits effectively and maximize their guiding roles in cultural education,laying a solid moral and ethical foundation for a law-based society.Additionally,it is crucial to effectively utilize the normative and regulatory role of such habits within the space of social autonomy provide by laws,while mitigating adverse factors associated with them.By doing so,these case-solving habits can adapt with changing times under the rule of law.
