摘 要:南海海域具有较高的综合价值,但受到区域内争端与人类活动等多项因素的共同影响,目前海域内的环境保护现状不容乐观。海洋和平公园是一项兼具政治与环保目的,并且有望同时实现战略、治理以及规范三方面功能的划区管理工具,红海海洋和平公园即是该领域的实践先例,关于南海争议海域建立海洋和平公园的理论构想和讨论同样受学界与实践界关注。在南海局势不稳定性持续加剧、海域内生态安全问题日益严峻的现实背景下,创建南海争议海域和平公园面临一系列的优势、劣势、机会和威胁。只有在克服障碍、达成共识的基础上,才有可能建立起海洋和平公园,并真正发挥其应有的效能。然而,就当前的争端解决现状、保护区建设水平以及潜在参与国的意愿而言,南海争议海域和平公园建设仍任重而道远。In spite of the high comprehensive value,the disputed water in the South China Sea(SCS)is currently facing a challenging environmental protection situation due to factors such as regional disputes and human activities.The Marine Peace Park(MPP),serving both political and environmental purposes,is expected to function as an area-based management tool that can simultaneously address strategic,governance,and regulatory issues.As a practical precedent in this field,the RSMPP carries theoretical concepts and discussions about establishing a MPP in the disputed waters of the SCS.In the context of increasing instability and the escalating ecological security issues in the SCS,the South China Sea Marine Peace Park(SCSMPP)presents its own strengths,weaknesses,opportunities,and threats.Only by overcoming obstacles and reaching a consensus can it be possible to establish a MPP and truly unleash its potential.However,considering the current state of dispute resolution,the development level of marine protected areas,and the willingness of potential participating states,building a MPP in the SCS still faces formidable challenges.
