摘 要:司法案例是蕴含了法律原理与规则的法院判决。在知识产权本科教学中,经法院或行政机关裁决后生效的司法案例在教学中的应用与实践更生动和有效。新文科背景下知识产权本科教育的定位、知识产权法学课程的专业性和知识产权理论与实践的前沿性及知识产权人才培养的目标决定了司法案例在知识产权本科教学中的必要性。司法案例可以运用于知识产权课堂理论教学和社会实践教学。司法案例教学应培养学生的自学能力,养成勤思考、善动手的好习惯,并且建立知识产权教学库,另外作为教师应及时关注前沿问题,提高教学能力。司法案例教学是需要教师与学生的共同努力和齐心合力才能完成的教学活动。Judicial cases are court decisions including legal principles and rules.In the undergraduate teaching of intellectual property,judicial cases,which have come into effect after the decision of the court or administrative organs,are more vivid and effective in the application and practice of teaching.It is necessary to apply judicial cases in the undergraduate teaching of intellectual property due to the positioning of undergraduate education of intellectual property in the context of new liberal arts,the specialization of intellectual property law courses and the frontiers of intellectual property theory and practice.Judicial cases can be used in intellectual property classroom and practical teaching.Judicial case teaching should cultivate students self-learning ability,develop good habits of thinking often and operating well,establish a teaching library of intellectual property cases.Teachers should pay attention to frontier issues and improve teaching ability.Judicial case teaching is a teaching activity that requires the joint efforts and concerted efforts of teachers and students.
