金融借款合同利率司法保护上限问题研究

摘　　要：《新民间借贷司法解释》形成了金融借贷和民间借贷合同利率上限的“双轨制”裁判标准,使金融借贷与民间借贷利率上限“倒挂”。准确理解适用《民法典》第680条第1款之规定,应对金融借款合同和民间借贷合同进行平等保护。从域外法来看,多数国家对贷款利率上限进行了规制。我国应设置最高利率上限,同时区分不同的金融借款合同类型,在最高利率上限以下分门别类地设置借款合同利率上限。确定金融借款合同利率上限应坚持金融服务实体经济原则、防范金融风险原则和保护金融消费者合法权益原则,区分金融借款合同的类型,坚持在民间借贷利率上限以下确定金融借款合同利率,围绕LPR与存款利率的利差确定金融借款合同利率司法保护的合理区间。After the implementation of the New Judicial Interpretation on Private Lending,a“dual-track”judgment standard has been formed for the ceiling on interest rate of financial loan contracts and private loan contracts,which makes the ceiling on the interest rate of financial loan contracts and private loan contracts“upside down”.Accurate understanding and application of the provisions of Article 680,paragraph 1 of the Civil Code requests equal protection for financial loan contracts and private loan contracts.From the perspective of extraterritorial law,most countries regulate the ceiling on loan interest rate.Our country should set the ceiling on interest rate,distinguish different types of financial loan contracts,and set the ceiling on loan contract interest rate below the ceiling on interest rate according to different contract types.The determination of the ceiling on interest rate of financial loan contracts should adhere to the principle of financial services to the real economy,the principle of preventing financial risks and the principle of protecting the legitimate rights and interests of financial consumers,distinguish the types of financial loan contracts,set the interest rates of financial loan contract below the ceiling of private lending interest rates,and determine the reasonable range of judicial protection of financial loan contract interest rates around the spread of LPR and deposit interest rates.
