《对外关系法》背景下我国体育对外援助的规制完善

摘　　要：体育对外援助是我国对外交流的重要组成部分,基于管理、规范等需求在多年的实践中产生了一系列针对体育对外援助的规制。本研究通过考察当前我国体育对外援助规制的现状,认为我国体育对外援助存在着规制手段失衡、规制法律缺位、规制能力不足等问题。《对外关系法》作为我国发展对外关系的基础性法律,其颁布与施行为体育对外援助规制确定了新理念、新框架和新任务,也为解决上述问题提供了指引。在此背景下,我国体育对外援助需回应《对外关系法》的要求完善规制:以构建人类命运共同体理念为指引,更新体育对外援助的规制手段;以《对外关系法》为依据,健全体育对外援助规范;以深化拓展为任务,提升体育对外援助的规制能力。Sports foreign aid is an important part of China’s external contacts.A series of regulations for sports foreign aid have emerged in years of practice based on management,standardization and other requirements.By examining the current situation of sports foreign aid regulations in China,this paper points out that there are problems in China’s sports foreign aid regulations such as imbalance in the means of regulations,absence of regulatory laws and insufficient regulatory capacities.As a fundamental law for the development of China’s foreign relations,the promulgation and implementation of the Law on Foreign Relations of the People’s Republic of China has established a new concept,a new framework and a new task for the sport foreign aid regulations,and has provided guidelines for solving the above-mentioned problems.In this context,China’s sports foreign aid regulatory measures need to respond to the Law on Foreign Relations of the People’s Republic of China,which includes:updating the regulatory means of sports foreign aid guided by building a community with a shared future for mankind;establishing a perspective legal framework for sports foreign aid based on the Law;and enhancing the regulatory capacities of sports foreign aid with the goal of deepening and expanding.
