摘　　要：禁诉令在知识产权案件尤其是标准必要专利纠纷中频频出现,催生了全球禁诉令大战。禁诉令制度与涉外司法中管辖权的争夺是相伴相生的,客观上对于恰当解决国际平行诉讼冲突,维护司法主权,以及作为体现一定导向性的公共政策,都具有积极的意义。我国当前立法缺乏关于禁诉令的直接规定,法院在数起知识产权诉讼案件中能动地扩张解释和适用行为保全规定,取得了一定的效果,但也面临着质疑。站在国家利益的高度来看,未来我国法院在涉及禁诉令的案件时,应从诉源治理的理念出发,树立慎用的态度,严格审查路径、限定适用范围,充分尊重国际礼让原则,充分发挥我国司法制度中重视调解的特色和优势,为禁诉令国际难题提供中国式的解决方案。Anti-suit injunctions have emerged frequently in the realm of intellectual property rights,especially in the disputes over standard-essential patents,leading to global conflicts over anti-suit injunction conflicts.The anti-suit injunction institution goes hand in hand with the competition for jurisdiction in foreign-related justice,and is objectively of positive significance for the proper resolution of international parallel litigation conflicts,the safeguarding of judicial sovereignty,and acting as a public policy reflecting a certain degree of orientation.China's current legislation lacks direct provisions regarding the anti-suit injunction.In several intellectual property litigation cases,the court actively expands the interpretation and application of behavioral preservation provisions,which has been effective and challenged.To safeguard national interests effectively,Chinese court involvement in anti-suit injunction cases should be guided by the principle of managing the origin of litigation from now on,adopting a prudent approach,rigorously scrutinizing procedures,defining the scope of application,fully honoring the principle of international comity,leveraging the strengths and characteristics of China's judicial system,and offering Chinese-centric solutions to the international challenges associated with anti-suit injunctions.
