“受贿行贿一起查”之认识偏移及内涵重构

摘　　要：“受贿行贿一起查”作为当前反腐败治理的主要刑事政策之一,是反腐败工作持续向纵深推进的助力,是巩固压倒性胜利态势的现实需求,也是实现腐败治理现代化的重要一环。为顺应加大反腐败力度的要求,《刑法修正案(十二)》加大行贿犯罪的处罚力度,改变传统“重受贿、轻行贿”的惩治思想。行贿犯罪与受贿犯罪存在对合关系,对对合犯罪适用同一刑事政策是基本要求,故出现“同等罚”的呼声,但是“受贿行贿一起查”不等于实行“受贿行贿同等罚”的并重惩治模式。受贿与行贿的对合关系并不能表明需要同等处罚,且两者的法益侵害性相差甚远,同等处罚会引起其他社会矛盾,应当重新审视“受贿行贿一起查”的刑事政策的实质内涵,严密法网,坚持宽严相济、实事求是,实现贿赂犯罪罪刑均衡。As one of the main criminal policies of the current anti-corruption governance,“giving bribes and taking bribes investigation”is a support for the continuous deepening of anti-corruption work,a practical need to consolidate the overwhelming victory situation,and an important part of achieving modernization of corruption governance.In order to comply with the require-ment of strengthening anti-corruption efforts,the Criminal Law Amendment(12)increases the punishment of giving bribes crimes and changes the traditional punishment idea of“heavy taking bribes,light giving bribes”.Giving Bribes crime and taking bribes crime have an overlap relationship,and applying the same criminal policy to the overlap crime is the basic requirement,so there is a call for“equal punishment”.However,“investigation of taking bribes and giving bribes together”does not mean the imple-mentation of“equal punishment for giving bribes and taking bribes”and the overlap relationship between giving bribes and taking bribes does not indicate the need for equal punishment,and the infringement of legal interests between the two is very different.The same punishment will cause other social contradictions,we should re-examine the essence of the criminal policy of“giving bribes and taking bribes investigation together”,tighten the legal net,adhere to leniency and severity,seek truth from facts,and achieve the balance of crime and punishment in bribery crime management.
