摘　　要：目前,中国数据交易所“国际板”已由规划愿景转化为现实图景,但面向“国际板”的基础制度规范却至今“未露踪影”,致衍生风险潜存其中亟待化解。依循属性对比,数据交易区别于证券交易的独特性为“国际板”的制度规范勾勒基础框架;经由风险解构,跨境交易风险与数据跨境风险的叠加为“国际板”的制度规范标注规制重点;基于现状检视,跨境数据交易的治理机制障碍为“国际板”的制度规范指明补缺方向。今后,数据交易所“国际板”的法律规范应统筹“数据交易治理”与“跨境数据流通治理”的双重面向,兼顾监管层与交易商的主体规范、制定“全周期”的跨境交易规则、在协同架构下充实监管措施并对外完善跨境数据交易治理规范,为数据交易所“国际板”的高质量发展提供有效的法律保障。The international board of data exchange has been transformed from a planning vision to a realistic picture,but the legal norms of the international board have not yet been seen,resulting in potential derivative risks.According to the comparison of attributes,the uniqueness of data transactions from securities transactions outlines the basic framework of the international board legal norms.Through risk deconstruction,the superposition of cross-border transaction risks and data cross-border risks is the focus of the international board legal norms.Based on the review of the status quo,the obstacles in the governance mechanism of cross-border data transactions point out the direction to fill in the gaps in the legal norms of the international board.In the future,the legislation of the international board should consider the main regulations of regulators and traders,formulate full-cycle cross-border transaction rules,enrich regulatory measures under a collaborative framework,and improve cross-border data transaction governance regulations externally.It provides a solid and effective legal guarantee for the high-quality development of the international board of data exchanges.
