论“存证平台”的出现对档案界的警示

摘　　要：电子时代出现了若干“存证平台”,其功能主要是用于存放电子数据证据或电子数据证据真实的验证手段,以及解决电子数据证据真实性的可验证。产生这一现象的根本原因是电子时代档案界的不作为。一方面,电子时代法治社会解决电子档案的真实可信问题刻不容缓;另一方面,当下的档案室和档案馆并没有为电子档案的真实性维护做出令人信服的举措,导致其所存电子档案的真实度难以采信。其实,从“存证平台”视角来审视,我们发现,法律规定集中存放与管理档案的专门机构——档案室和档案馆原本就是一个“存证平台”,存证与出证本是档案界的天职和法律赋予的阵地,这在纸质时代得到了充分体现与反映,可电子时代变得困难了。如何延续档案室和档案馆在电子时代的“存证平台”功能,守住这一阵地,这就需要档案界对“存证平台”的出现有足够的敏感,引起高度警觉,防止档案管理部门之外的“存证平台”做大做强后,导致档案室和档案馆在电子时代的弱化、边缘化,甚至有被取代和抛弃的可能。为此,档案界必须立即着手有效解决电子档案真实可信问题。In today's digital age,the importance of“depository platforms”cannot be overstated.These platforms serve as a crucial means of storing electronic data evidence and ensuring the verifiable authenticity of such evidence.The fundamental cause of this phenomenon is the inaction of the archives circle in the electronic age.On the one hand,it is imperative for the legal society to address the issue of truthfulness in electronic archives.On the other hand,the current lack of convincing measures to maintain the authenticity of electronic archives has resulted in a crisis of trust.The law mandates the centralized storage and management of archives,highlighting the natural duty of the archival industry to serve as a“depository platform”.While this function was easily fulfilled in the paper era,the electronic age presents new challenges.To maintain their relevance and importance in the digital era,archives must adapt to the role of a“depository platform”.The archival community must be vigilant in preventing external“depository platforms”from overshadowing and potentially replacing traditional archives.It is crucial for the archival community to address the authenticity of electronic archives promptly and effectively.
