摘　　要：江苏上海地方法院是近代上海区域法制中重要的组成部分,该院在江苏上海地方审判厅的基础上改组设立。作为法制近代化产物的新式法院,不仅没有获得系统性制度和资源的支撑,反而饱受中国传统文化中负面因素的影响,“郑杨案”的发生更是使得法院一度陷入困境。沈锡庆接任院长后,面临案件数量激增,司法行政事务繁杂和涉外案件众多的艰难处境,通过其积极努力一一作出了应对。上海的特殊地位常引来中外各方势力在此博弈。上海特别市建立后,更出现与江苏省的省市之争,使得江苏上海地方法院身处夹缝之中,处境日囧。然而在有限的空间中,其仍实现了华界法制的全面近代化并协助收回了租界法权。Jiangsu Shanghai District Court is an important part of the regional legal system of Shanghai in modern times.It was reorganized and established on the basis of former Jiangsu Shanghai District Judgement Hall.As the product of legal system modernization,the new court did not obtain the systematic support of regime and resources,but suffered from the negative influence of the traditional Chinese culture,and"Zheng Yang case"made the court once in a predicament.After taking over as the President of the court,Shen Xiqing faced difficulties like the surging number of cases,complicated judicial and administrative affairs,and numerous foreign-related cases,and made positive efforts to deal with them one by one.The special status of Shanghai had attracted all forces domestic and abroad in this game.After the establishment of Shanghai Special City,there appeared the"provincial dispute"with Jiangsu Province,which put Jiangsu Shanghai District Court in a dilemma.However,in the limited space,it still achieved the comprehensive modernization of Chinese legal system and provided assistances in recovering the legal rights of concessions.
