摘　　要：寻求人大监督权运作的最佳模式,旨在为人大监督行动提供一个基本的最优决策框架。人大监督权运作最佳模式的评判标准,包含价值正当性、规则合法性和功能有效性三项内容。在价值正当性上,围绕发展全过程人民民主的最高价值目标,根据中国民主的人民性和全过程两大特性,采取具体可行的行动方案。在规则合法性上,人大应当依照法定权限和程序监督,具体通过扎根人大监督“事务本质”的法解释方法吸纳新型监督方式,同时对法定程序进行纵向细化和横向衔接。在功能有效性上,基于人大监督效益最大化的期盼,依次通过监督能力与监督职权相匹配原理、成本收益分析,着力进行人大监督运作中的权限再配置和程序再设计。It is a topic full of theoretical charm that finding the best mode of operation of people's congress supervision power to provide a fundamental decision-making procedure.The criteria for judging the best mode include value legitimacy,rule legality,and function effectiveness.In terms of value legitimacy,aiming at the highest value goal of developing the whole process people's democracy,supervisors can take specific action plans around the two characteristics of China's democracy including people's nature and the whole process.In terms of rule legality,the supervisors of the people's congress could adopt interpretation methods in line with the essence of affairs to absorb new forms of supervision,at the same time refine the implementation in the vertical dimension of the legal procedure,and link up and coordinate in the horizontal dimension.In terms of function effectiveness,redivision of supervision authority of the people's congress shall be through the principle of matching the supervision ability with its supervision authority,and redesign of supervision procedure shall be through cost benefit analysis.The best mode can continue to feed back and support the optimization of the revision of Supervision Law of the People's Congress.
