信用联合奖惩的制度演化与法理逻辑

摘　　要：信用联合奖惩作为我国社会信用体系建设的核心实施机制,以其显著的制度创新性而备受关注。尽管法治化是解决信用规制过度与泛化等现实问题的主要出路,但将其简单裁剪纳入既有法治框架的思路并不可行,目前尚须充分探索信用联合奖惩的演化规律和运作原理。借助当代信息数据技术,信用联合奖惩通过可能的间接或直接干预路径整合非正式规范的信息资源及激励资源,实际创设一种法治、德治与自治相结合的新型制度规范。这种混合规范的机制设计,既要恰当理解守信奖励与失信惩戒的内在一致性,又要把握两者在实施成本和效果上的差异性。展望未来,信息技术的进步有望持续降低制度的实施成本,信用联合奖惩可视为规范融合制度变迁趋势的理论预演和实践探索。The credit joint reward and sanction is the central implementation mechanism of China's credit system project,which has drawn much attention and controversy owing to its institutional originality.Although legal regulation is the main solution to the practical excessiveness and generalization of credit regulation,the notion of merely modifying the existing concept and adapting it to the current legal framework is untenable.There is a need to comprehensively investigate the evolution pattern and operating principle of the credit joint reward and sanction.Using the contemporary information and data technology,the credit joint reward and sanction integrates the information and incentive resources of informal norms through conducting indirect or direct intervention,and gives rise to the new institutional norm integrating law,morality and autonomy.The mechanism design of integrating norms should not only require adequate control of intrinsic similarities between integrity reward and dishonesty sanction,but also respect differences in implementation cost and effect.In prospect,the advancement in the information technology promises to continuously reduce the cost of institutional implementation,and the credit joint reward and sanction can be regarded as a theoretical rehearsal and institutional exploration for the institutional change trend of integrating norms.
