摘 要:清代涉“义绝”案例显示,“义绝”除作为婚姻强制解除的依据外,更是包含舍弃涉服制律例规范且支持“以凡论”律例适用的理由,据此法律修正式的司法适用得以实现。法律修正的实现需要反对法律规则适用的理由在与其支持理由的权衡中“胜出”,因此“义绝”当为法律修正实现条件的满足,即引入的理由在与支持涉服制律例规范的理由进行权衡时“胜出”。在“义绝”的权衡中,“胜出”的理由以“恩”“义”为主要内容,具备法律原则的属性,且可与回溯所得相应涉服制律例规范的根本理由相印证,故可确立恩义原则。恩义原则作为情理原则具体化的下位原则,仅系情理原则的部分内容,可由此透视情理原则与以恩义原则为代表的具体原则间的体系化关联,并从原则的体系化角度对清律进行再认识。Cases in Qing Dynasty show that Yi-Jue is not only related to the dissolution of marriage,but contains the reason of abandoning the rules and regulations of the uniform system,so that the legal amendment in judicial application can be realized.The realization of legal amendment requires that the reasons opposing the application of legal rules win out in the balance with the reasons supporting them.Therefore,the reasons introduced by the Yi-Jue won out in the balance with the reasons supporting specific statutes,and the legal amendment could take place.The main content of the reason introduced in the justice is “grace” and “righteousness”,which can be justified as legal principle of En-Yi.As the subordinate principle of the concretization of the principle of Qing-Li,the principle of En-Yi is only a part of the principle of Qing-Li.These legal principles constitutes a principle system,which can help us re-understand the Qing law from the perspective of principle system.
