家庭关系法律适用和续造的抽象界限

摘　　要：相对于同受民法调整的财产关系,家庭关系的法律适用和续造受到更为严格的限制。立法者在三个层面为家庭关系的法律适用和续造设置了界限。其一,在法内空间与法外空间的划定上,立法者保持了谦抑性。法官不能通过法律适用和续造突破立法者预设的界限,将亲密关系不当法律化。承认亲密关系领域的私人自治并适用或者续造相关规范本身就意味着亲密关系的法律化。其二,在法内秩序中,立法者通过价值开放性概念,引入以利他和关怀为显著特征的家庭伦理,在增加法价值秩序弹性的同时,在形而上的层面进一步限制了法官的法律适用和续造活动。其三,即使采法源开放立场,在家庭关系类型法定主义之下,法官不能通过法律适用和续造变相地在法秩序中创设新的家庭关系类型。这会背离立法者的法政策决断以及当事人的意愿。相对于动态开放类型,在封闭类型中法官适用法律的裁量权和法律续造权受到更为严格的限制。The application and development of law regarding family relations are subject to stricter limits than property relations,which are also regulated by civil law.The legislator has set boundaries for the application and development of law regarding family relations at three levels.Firstly,the legislator has maintained modesty in demarcating the boundary between legal space and extra-legal space.Judges cannot overstep the boundaries set by the legislator through the application and development of law and improperly legalize intimate relationships.The recognition of private autonomy in the field of intimacy and the application or development of the relevant norms implies in itself the legalization of intimacy.Secondly,within the legal order,the legislator,through the concept of openness to value,introduces family ethics characterized by altruism and caring,which further restricts the judge's activities of application and development of law at the metaphysical level,while increasing the flexibility of the legal value order.Thirdly,even adopting an open attitude toward legal sources,under the principle of numerus clausus,judges cannot create new types of family relations in the legal order in disguise through the application and development of the law.This would be a departure from the legislator's legal policy decisions and the will of the parties.In contrast to the dynamic open type,judges' discretion in applying the law and law development power are subject to more stringent restrictions in the closed type.
