摘 要:退休制度作为应对人口老龄化最为重要的法律制度,应与时俱进地实现改革与优化。应在系统梳理立法形式体系和内容体系的基础上,探寻立法完善的多元路径和可行举措。基于法律文本与法规政策文本双重视角的梳理和评析,可以准确把握我国退休制度的现实构造及其历史轨迹,揭示其利弊得失,为当代中国退休制度改革及其立法完善提供理论支撑。在应对人口老龄化的时代背景下,退休制度需要通过立法加以承载和确立,惯例的法律化与政策的法律化需要同步推进。实现中国退休立法的体系化,在面对《劳动法》修改、“劳动基准法”制定和“劳动法典”编撰等路径选择时,都应认真对待退休制度改革及其立法完善问题。The retirement system,as the most important legal system to address population aging,should be reformed and optimized in a timely manner.Based on a systematic review of the legislative form system and content system,it is necessary to explore diverse paths and feasible measures for legislative improvement.Through the dual perspectives of legal texts and regulatory policy texts,this study meticulously reviews and critiques to accurately grasp the current structure and historical trajectory of China's retirement system,revealing its advantages and disadvantages,and providing theoretical support for the reform and legislative improvement of the contemporary Chinese retirement system.In the context of dealing with population aging,the retirement system needs to be carried and established through legislation.The legalization of customary laws and policies should be advanced in parallel.To systematize China's retirement legislation,serious consideration should be given to the reform and legislative improvement of the retirement system when facing choices such as amending the"Labor Law",drafting the"Labor Standards Law",and compiling the"Labor Code".
