高校法律顾问单位参与学校治理若干问题的探究

摘　　要：我国高等院校法律顾问制度已初具雏形,但高校法律顾问有关的制度建设、工作模式、运行机制等仍处于完善阶段。文章结合高校法律顾问单位业务内容、工作开展等参与治理实际,立足制度必要性和涉法事务类别,思考提出法律顾问单位参与学校治理的有效路径,以期理顺高校与法律顾问单位之间的关系,更好地发挥法律顾问单位在涉校重要事项、决策合法审查、规章制度完善、重大事件处置等工作中的作用,服务高校治理体系完善和治理能力提升。The institution of legal advisor in colleges and universities in China has taken shape,but the system construction,working mode and operation mechanism in colleges and universities are still in the stage of improvement.Based on the legal advisory units′real work as well as the necessity of the system and the categories of legal affairs,this paper puts forward effective ways for legal advisory units to participate in school governance,which is expected to straighten out the relationship between colleges and legal advisory units,better play the role of legal advisory units in important matters related to schools,legal review of decision-making,improvement of rules and regulations,and handling of major events,and to serve the improvement of both governance system and governance capacity in colleges and universities.
