中国特色现代大学制度视域下大学权利保障机制研究

摘　　要：为推动构建具有中国特色的现代大学制度,以制度建设助推高等教育现代化,基于制度变迁理论,分别从法律权利、道德权利和习俗权利三个方面,深入分析我国大学权利保障问题。提出的破解策略为:需要明确新时代大学的“王牌”权利,以保障大学自治权;进一步明晰权利与权力、原则与规则之间的关系,以准确把握现代大学权利的实质;通过大学章程建设推动建立宪法选择规则,提升大学内部治理体系与治理能力现代化水平。In order to promote the construction of a modern university system with Chinese characteristics and to boost the modernization of higher education through the institutional construction and based on the theory of institutional change,the paper analyzes the issue of university rights protection from three aspects of:legal rights,moral rights and customary rights and proposes that the“trump card”rights of the universities in the new era be determined to guarantee the autonomy of the universities,the relationship between rights and powers,principles and rules be clarified to accurately grasp the essence of the rights of modern universities and the constitutional rules of choice be established through the construction of university charters to improve the modernization of the internal governance system and the governance capacity of universities.
