摘　　要：指导性案例的应用效果备受学术和审判实务界关注,2023年最高人民法院发布2批13例指导性案例,本文以最高人民法院已发布的39批224例指导性案例作为研究对象,“北大法宝—司法案例库”收录的裁判文书作为实证研究样本,从多个视角出发,对指导性案例发布和应用情况进行比较研究。对11286例应用案例进行实证分析,在整体和个案应用的研究基础上,详细分析案由专题、应用法院、应用主体和应用内容等要素。综述中通过数据展现指导性案例在实体和程序指引的不均衡、失效运行机制的规范以及赋予指导性案例刚性效力等方面的建议,呈现2023年度指导性案例在司法实践中的变化与发展。The application effect of guiding cases is highly concerned by the academic and trial practice circles.In 2023,the Supreme People's Court issued 2 batches of 13 guiding cases,and this paper takes the 39 batches of 224 guiding cases that have been issued by the Supreme People's Court as the object of study,and the adjudication documents included in"Beida Law Treasure-Judicial Case Database"are used as the empirical research samples,and a comparative study of the guiding cases release and application is carried out from multiple perspectives.11,286 application cases are empirically analysed,and on the basis of overall and case-by-case application research,elements such as the topic of the case,the court of application,the subject of application and the content of application are analysed in detail.The overview presents the changes and development of guiding cases in judicial practice in 2023 through data showing the imbalance of substantive and procedural guidance,the specification of the failure operation mechanism and the suggestion of giving rigid effect to guiding cases.
