摘 要:近些年来,学术界兴起了一种在刑法以外重构行政刑法的中义行政刑法理论,主张行政刑法既独立于刑法,也独立于行政法,作为介于行政处罚与刑罚之间的新的独立的刑事性行政制裁体系而存在。由此,行政处罚法与刑法之间便被开辟出一个冠以“行政刑法”之名的新界域。这一理论创造有助于实现惩罚违法者的程序正义与保障被追究者的合法权利,对从刑法范畴内定位行政刑法的狭义说形成了有力冲击。不过,刑事性行政制裁体系的规范依据重塑、处罚方式整合、追究程序建构等方面,在理论设计上还存在一些逻辑困境及附随隐患,值得关切与反思。在刑法以外的行政刑法的若干障碍未能得以有效解决的条件下,坚持行政刑法狭义说方是当前最为适宜的选择。In recent years,a theory of administrative criminal law has emerged in the academic circles,which reconstructs administrative criminal law outside criminal law,and advocates that administrative criminal law is independent of both criminal law and administrative law,and exists as a new independent criminal administrative sanction system between administrative punishment and penalty.Thus,a new field has been opened between administrative punishment law and criminal law in the name of"administrative criminal law".The creation of this theory is conducive to the realization of the procedural justice of punishing lawbreakers and the protection of the legitimate rights of the accused,and has a strong impact on the narrow definition of administrative criminal law.However,there are still some logical dilemmas and hidden dangers in the theoretical design of the criminal administrative sanction system in terms of the reconstruction of norms,the integration of punishment methods and the construction of investigation procedures,which are worthy of concern and reflection.Under the condition that some obstacles of administrative criminal law outside criminal law cannot be solved effectively,it is the most appropriate choice to insist on the narrow definition of administrative criminal law.
