摘　　要：地理标志产品是地理标志制度的核心概念,它界定了地理标志权的保护范围,而产品标准则是区分地理标志产品与其他同类产品的依据。因此,应注重地理标志产品标准的合理性和科学性。然而,实践中我国地理标志产品标准合理性缺失,主要表现在两个方面:对特定地区自然因素和人文因素的重视不足;过度强调生产技术性指标。在地理标志制度的改革中,应要求在产品标准中更加强调自然因素和人文因素的影响,同时还要考虑产品标准的难易程度,并在产品标准中留出一定的弹性空间以调整传统与创新之间的平衡。Geographical indication is one of the intellectual property rights protected by Chinese law.As an institutional tool to promote rural revitalization,China's geographical indication system needs further reforms and improvements.It is currently at a critical stage of reforming the geographical indication system.We should start by clarifying basic concepts and discussing specific issues concerning the operation of the geographical indication system,so as to push forward reforms and improve the system.Geographical indication products are the core concept of the geographical indication system.They define the scope of protection of geographical indication rights.Product standards serve as the basis for distinguishing geographical indication products from other similar products.Therefore,the rationality and scientific rigor of geographical indication product standards should be emphasized.However,there are problems with China's geographical indication product standards.On one hand,the standards do not pay enough attention to specific regions'natural factors and humanistic features.On the other hand,they overstress production technology indices.In reforms of the geographical indication system,more emphasis should be placed on the influence of natural and human factors on product standards.And the difficulty of product standards should be considered,and a certain flexibility should be left in product standards to adjust the balance between tradition and innovation.
