论老龄化背景下信托与意定监护的协同应用

摘　　要：在财产管理方面,意定监护制度存在权责范围模糊、监护人财产管理能力有限的缺陷。在老龄化背景下,信托与意定监护的协同应用能够弥补这种不足,实现财务专业规划和风险有效隔离。信托与意定监护的协同应用具有可行性,两大制度在内在设计上具有重合性。同时,有限监护理念予以理论支撑,信托行业的相关尝试提供实践经验。信托与意定监护的协同应用需要加强规则供给,着手构建公共受托人制度,扩大信托监察人的适用情形,并且适度限制监护人终止信托的权利。对于协同应用路径下信托方式的选择,应以生前信托为基础,以自益信托为指向。In terms of property management,the intentional guardianship system has the defects of the ambiguous scope of authority and responsibility and the limited ability of guardians to manage the property.In the context of aging,the synergistic application of trust and intentional guardianship can make up for such deficiencies and realize professional financial planning and effective risk isolation.The synergistic application of trust and intentional guardianship is feasible and the two systems overlap with each other in terms of internal design.At the same time,the concept of limited guardianship provides theoretical support and the attempts of the trust industry provide practical experience.The synergistic application of trust and intentional guardianship needs to strengthen the provision of rules,begin to construct the public trustee system,expand the applicable circumstances of the trust inspector and appropriately restrict the guardians’right to terminate the trust.The choice of trust mode under the path of synergistic application should be based on inter vivos trusts and directed by self-beneficial trust.
