多元协同视域下突发公共卫生事件的法治化应对

摘　　要：在全面依法治国的时代背景下,突发公共卫生事件应通过法治化的路径予以应对:其处理,要坚持权利保障、依法行政、信息公开和协同治理的原则;其实现“依法防控、科学防控、联防联控”,要从立法、执法和社会协同等方面进行省思--在立法完善的路径上,应制定《紧急状态法》,完善突发事件预警制度,明确社会主体“分级负责”的权责范围;在执法改进的路径上,应构建统一领导的决策指挥与协调应对机制,完善信息报告制度,严禁越权行政和违法行政;在社会协同的路径上,应充分发挥网格化社会治理机制与各类社会组织的协同治理功能,夯实法治的社会基础。In the context of a comprehensive rule of law,public health emergencies should be handled through legal governance.And the handling needs to adhere to the rules of rights protection,legal administration,information disclosure and collaborative gover⁃nance.The realization of“legal prevention and control,scientific prevention and control,joint prevention and control”should be based on the reflection from the aspects of legislation,law enforcement and social collaboration.In terms of legislative improvement,The Emer⁃gency Law should be formulated,the emergency early warning system should be perfected,and the scope of power and responsibility of social subjects should be clarified.In terms of law enforcement improvement,we should build a decision-making command and coordi⁃nation mechanism of unified leadership,improve the information reporting system,and strictly prohibit administration beyond the power and illegal administration.In terms of social collaboration,we should give full play to the collaborative governance function of grid social governance mechanism and various social organizations,and consolidate the social foundation of rule of law.
