国际贸易与环境条约冲突预防机制研究

摘　　要：本文探讨可能有助于克服国际贸易与环境条约间冲突的法律方法。传统上,系统整合原则一直是将国际法视为一个整体概念的工具,也是避免国际条约间冲突的可行手段。然而,系统整合原则仅适用于国际裁决层面。这使现有文献在避免条约冲突的需要与系统整合原则仅能发挥的有限作用间留下了一个空白。在分析相关资料的基础上,本文探讨系统整合原则所蕴含的基础原则,包括相互支持原则、善意原则、合作原则和协调原则。本文认为,这些基础原则不仅能在国际裁决层面,而且能在国际组织和国内层面有助于预防条约冲突、促进条约间的和谐。因此,国际贸易与环境条约冲突预防机制应当既包括系统整合原则,又包括其蕴含的基础原则,从而在国际裁决、国际组织和国内三个层面有效避免实践中的条约冲突。This article discusses legal methods that may help overcome conflicts between international trade and environmental treaties.Traditionally,the principle of systemic integration has been a tool for conceptualising international law as a whole,as well as a viable means for avoiding conflicts between treaties.However,systemic integration is only applicable at the international adjudicative level.This leaves a gap in existing literature between the need to avoid treaty conflicts and the rather limited role that systemic integration can play.Based on a close analysis of relevant sources,this article unravels a number of principles that underpin systemic integration,including the principles of mutual supportiveness,good faith,cooperation,and harmonisation.It freshly argues that these underlying principles have the potential to help avoid treaty conflicts and are capable of driving reconciliation at not only the international adjudicative level,but also the international institutional and domestic levels.Therefore,international trade and environmental treaty conflict prevention mechanism should include both the principle of systemic integration and its underpinning principles,which could be deployed to effectively avoid conflicts in practice at the international adjudicative,international institutional and domestic levels.
