摘　　要：随着社会与经济的不断进步,肖像权的商业化利用成为普遍现象,随之而来也出现了许多新的法律风险与问题,为了更好的规范肖像权的商业化市场,我国民法典将人格权独立成编,除了民法典总则所规定的一般法定解除权之外,也为人格权领域的肖像权设定了新的特殊法定解除权,这也成为人格权领域立法的一大亮点。本文以肖像权许可使用合同的法定解除权为主题,通过规范分析法再结合实践,探讨该法定解除权在实际运用中存在的问题,例如明确肖像许可合同中的合理期限,确定肖像许可合同解除之后的溯及力问题,以期望为肖像许可合同行使法定解除权所产生的问题提供未来的完善方向。With the continuous progress of society and economy,the commercial utilization of portrait right has become a common phenomenon,and many new legal risks and problems have also emerged.In order to better regulate the commercial market of portrait right,China’s Civil Code has independently compiled the right of personality,in addition to the general legal right of dissolution stipulated in the general provisions of the Civil Code,it has also set up a new special legal right to release the portrait right in the field of personality rights,which has also become a highlight of the legislation in the field of personality rights.This paper takes the legal rescission right of portrait right license contract as the theme,and discusses the problems existing in the practical application of the legal rescission right through normative analysis combined with practice,such as clarifying the reasonable period in the portrait license contract and determining the retroactivity after the rescission of the portrait license contract.It is expected to provide a perfect direction for the future problems arising from the exercise of statutory rescission rights in portrait licensing con-tracts.
