袭警罪的限缩适用研究

摘　　要：自袭警罪从妨碍公务罪的从重情节分离成独立罪名以来,涉嫌袭警罪的案件数量增加明显,有不当扩张适用的趋势。结合司法实践中部分不当扩张适用的典型案例,通过法益分析的方法,对袭警罪的构成要件进行多个维度的解释。袭警罪中的暴力是指物理上的强制力,并且需要达到一定程度;袭击需要具备突然性的行为特征、袭击的行为对象是警察的人身而非物品,并袭击需要造成妨碍公务执行的行为结果;正在执行职务,要采用职务认定标准,并且不能出现重大且明显的违法;人民警察应局限于国家公务员,而不包括警务辅助人员;袭警罪加重犯的不完全列举应按照同类解释的规则限缩,并应采用具体危险犯的标准。Since the crime of attacking police was separated from the aggravating circumstance of the crime of disrupting public service into an independent crime,the number of suspected cases of attacking on police has increased significantly,and there is a trend of improper expansion of application.Combined with some typical cases of improper expansion and application in judicial practice,this paper explains the constitutive requirements of crime of attacking the police in multiple dimensions through the method of legal interest analysis.Violence in the crime of attacking police refers to physical force,and it needs to reach a certain degree;the attack needs to have the characteristics of sudden behavior,the object of the attack is the person of the police rather than the object,and the attack needs to cause the result of obstructing the execution of official duties;the job identification criteria should be adopted when the job is being performed,and there should be no major and obvious violations of the law;the people’s police should be limited to state civil servants and not include police auxiliaries;the incomplete listing of aggravated offences of assaulting police officers should be limited according to the rules of similar interpretation and the criteria of specific dangerous offences should be applied.
