论中国专业性社会调解的专业化特色

摘　　要：深入审视和总结中国专业性社会调解的专业化特色是明确竞争优势和发展方向、坚定中国调解道路自信的必然要求。中国专业性社会调解与基层社区人民调解的角色定位明显不同,历经初创摸索、正式确立、全面展开三个发展阶段,逐步形成了四个方面的专业化特色。在解纷知识与经验方面,以包容性载体优化供需平衡,以整体性视角强化互补性关系,以可视化方式增强可接受性。在服务与创新能力方面,采取从纠纷调解到综合治理的功能拓展路径,推进专业调解服务清单化、标准化以及专业调解评价机制优化创新。在引领行业发展方面,推动确立行业性专业性调解的独立地位,引领各类调解优势互补、有机衔接、协调联动,推动优化矛盾纠纷多元化解格局,以及引领推动纠纷解决一体化建设。在指导思想方面,以习近平法治思想为指引,回答好“为谁专业化”“何种专业化”“如何专业化”等根本问题。In-depth examination and summation of the professional characteristics of the specialized social mediation in China are inevitable requirements for clarifying competitive advantages and development direction,and solidifying the self-confidence of China in the path of mediation.The specialized social mediation in China,the expected role of which is distinctly different from that of people's mediation in primary-level community,has undergone through three development stages,viz.,initial exploration,formal establishment,and comprehensive expansion,and has gradually formed the professional characteristics in four aspects.In terms of dispute resolution knowledge and experience,it includes optimizing the balance between supply and demand with inclusive carriers,strengthening the complementary relationships through a holistic perspective,and enhancing acceptability by means of visualization.In terms of service and innovation capability,it involves taking a path of function expanding from dispute mediation to comprehensive governance,promoting the itemization and standardization of specialized mediation service,and the optimization and innovation of specialized mediation evaluation mechanism.In terms of leading industry development,it concerns promoting the independence of industry-oriented specialized mediation,leading the mutual complementarity of advantages,organic connection,coordinated interaction between types of mediation,promoting the optimization of the diversified pattern of resolution of contradictions and disputes,and leading the integrated construction of dispute resolution.In terms of the guideline,it concerns the guidance of Xi Jinping Thought on the Rule of Law to give satisfactory answers to fundamental questions such as"whom is the professionalization for","what kind of professionalization is adopted",and"how to professionalize".
