我国无障碍环境建设法律激励制度研究

摘　　要：法律具有激励的功能,激励法具有激励人向上、向善的价值,能够指引个人和社会的发展方向。法律的激励功能与无障碍环境建设立法作为权利法、社会法、社会福利法的定位契合。无障碍环境建设需要激励全社会共建共治共享。我国无障碍环境建设相关的立法体系较为庞大,但未确立完善可行的激励机制。《中华人民共和国无障碍环境建设法》弥补了此前立法总体缺乏激励视角的不足,制定了数条激励条款,明确了共建共治共享的激励对象,规定了兼顾物质与理念无障碍的激励范围,设置了兼顾可行与多元的激励措施,标志着我国无障碍环境建设激励制度的新高度与新进展。但是,现有无障碍环境建设的法律激励制度仍然存在不足之处,基于激励法理论,建议完善《无障碍环境建设法》立法名称,强化对农村地区和残障儿童相关的无障碍环境建设激励,增加多元化、可操作性的激励措施,注重激励对象间的协作,促进不同位阶激励法的衔接配合。The law has the function of incentive,and the incentive law has the value of motivating people to be upward and good,and is able to guide the development of individuals and society.The incentive function of the law fits with the positioning of the legislation on construction of a barrier-free environment as rights act,social law and social welfare law.Construction of a barrier-free environment needs to incentivize the whole society to collaborate,participate and share.Chi-nese legislative system related to construction of a barrier-free environment is relatively large,but has not established a feasible and perfect incentive mechanism.The Barrier-free Environment Creation Law of the People’s Republic of China makes up for the lack of legal incentive perspective in the previous legislation,formulates several incentive clauses,clari-fies the incentive objects of collaboration,participation and sharing,stipulates the incentive scope of both material and conceptual barrier-free environment,and sets up feasible and diversified incentive measures,which marks the new height and new progress of the incentive system of construction of a barrier-free environment in China.However,there are still some deficiencies in the existing legal incentive system of construction of a barrier-free environment.Based on the theory of incentive law,it is suggested to modify the name of The Barrier-free Environment Creation Law of the People’s Re-public of China,strengthen the incentive of construction of a barrier-free environment for rural areas and children with disabilities,increase diversified and operable incentive measures,emphasize the collaboration between incentive objects,and promote the cooperation of incentive laws in different ranks.
