刑事一体化视角下轻罪出罪机制的路径探究

摘　　要：积极刑法观在我国确立的直接效应是轻罪时代的来临,轻罪时代应当实现与轻罪相匹配的轻缓化刑罚,然而我国既存的刑罚运行体系却不尽如人意,高居不下的起诉率、过高的实刑适用率以及显著的再犯率都昭示着轻罪存在重刑泛滥的风险。构建适当的轻罪出罪机制节制刑罚过度适用需要从刑事一体化的体系做出尝试,不仅要在实体层面强化“但书”的适用以及构建轻缓化的刑事制裁体系,还应当在程序层面通过扩大酌定不起诉制度的适用和实现附条件不起诉制度适用对象的扩展,来避免大量轻罪被定罪处罚。即通过实体和程序的双重路径进行出罪,实现轻罪的有效治理。The establishment of the positive criminal law concept in China has had the direct effect of ushering in the era of misdemeanour,which should be accompanied by lighter and more lenient penalties.However,China's existing system of penal operation is unsatisfactory.A high rate of prosecutions,an excessively high rate of application of actual penalties,and a significant rate of recidivism all indicate that there is a risk of a proliferation of heavy penalties for misdemeanour offences.In order to build an appropriate mechanism for misdemeanour offences,attempts should be made to control the excessive application of penalties from within the integrated criminal system,not only strengthening the application of"provisos"and building a system of mitigating criminal sanctions at the substantive level,but also expanding the application of the system of discretionary non-prosecution at the procedural level,and expanding the targets of the system of conditional non-prosecution to avoid a large number of misdemeanours from being punished by conviction.At the procedural level,a large number of misdemeanours should be avoided by expanding the application of the system of discretionary non-prosecution and by expanding the targets of the conditional non-prosecution system.The effective management of misdemeanours can be achieved through the dual paths of entity and procedure.
