摘　　要：该案例来自财政部发布的指导性案例第30号,主要涉及《政府采购法》在进口机电产品的政府采购活动的法律适用问题以及中标候选人是否具有作为原告提起行政诉讼的资格这两个问题。本文基于案情,结合相关法律法规进行分析,认为对于本案例中的机电产品的采购活动应该适用《政府采购法》,中标候选人不具有对于此次财政部的行政行为提起行政诉讼的原告资格。This case is from Guiding Case No.30 issued by the Ministry of Finance,and mainly involves the application of the Government Procurement Law to government procurement activities involving the import of mechanical and electrical products,and whether the winning candidate has the Standing to file an administrative lawsuit as a plaintiff.Based on the facts of the case and the analysis of relevant laws and regulations,this paper argues that the Government Procurement Law should be applied to the procurement of mechanical and electrical products in this case,and the winning candidate does not have the standing to file an administrative lawsuit against the admin istrative act of the Ministry of Finance.
