论疲劳审讯的认定

摘　　要：疲劳审讯是指剥夺被讯问人正常的休息权利,在其过于疲惫的情况下对其进行的讯问。疲劳审讯不仅危害了被讯问人的身心健康,侵害了被讯问人的基本人权,还有可能引发在审讯人员主观引导下对被讯问人的不实言论论述,从而导致冤假错案的产生,对整个社会的公平和正义产生不可逆的负面影响。因此,本文深入分析疲劳审讯的认定标准,首先分析疲劳审讯的概念、表现形式和危害,由此出发分析疲劳审讯应该怎样进行认定,从学界争议、认定现状到目前的存在问题分析疲劳审讯的认定标准。最后,给出疲劳审讯认定标准的建议和观点,即疲劳审讯这一讯问方式在我国界定标准不明、争议频发,因此需要建立一种合理的机制促进疲劳审讯的发展,促进我国的司法公正。由此,本文探究了如何以科学的方式减少疲劳审讯的数量和影响,以期对于侦查讯问活动进行更有效的管制。Fatigue interrogation refers to the interrogation that deprives the interrogated person of his normal right to rest and is conducted under the condition that he is too tired.Fatigue interroga-tion not only harms the physical and mental health of the interrogated,infringes on the basic hu-man rights of the interrogated,but also may lead to false statements on the interrogated under the subjective guidance of the interrogator,which leads to the appearance of unjust,false and wrong cases,and has an irreversible negative impact on the fairness and justice of the whole society.Therefore,this paper deeply analyzes the identification criteria of fatigue interrogation.First,it analyzes the concept,form and harm of fatigue interrogation.From this point of view,it analyzes how fatigue interrogation should be identified.Finally,suggestions and views on the identification standard of fatigue interrogation are given,that is,the definition standard of fatigue interrogation is unclear in China,and disputes frequently occur.Therefore,it is necessary to establish a rea-sonable mechanism to promote the development of fatigue interrogation and promote judicial justice in China.This paper explores how to reduce the number and influence of fatigue interroga-tion in a scientific way,in order to carry out more effective control on investigative interrogation activities.
