论党内法规对党内关系的调整——以《中国共产党统一战线工作条例》为视角

摘　　要：马克思主义政党的先进性要求需要党内法规制度予以保障。相较于国家法律,党内法规在调整方式上有其独特优势。党内法规以义务为本位划定党员和党组织的行为边界,党内法规制度对于执政党建设、国家治理、社会治理等都具有重大意义。党内法规作为党内具有法律性质的规范,仅应对党内关系进行调整,不应调整党外关系,其只对党员与党员、党员与党组织、党组织与党组织三组党内关系进行直接调整。但党自身特殊的政治法律地位决定了党内法规对党内关系的调整势必会影响党外关系,从而对党外关系产生间接调整作用。《中国共产党统一战线工作条例》很大程度上体现了党内法规调整的要求和特点,但存在超越范围调整党外关系的问题,需要在今后党内法规制度建设中予以矫正。The progressiveness nature of Marxist political parties requires the protection of intraparty laws and regulations.Compared to the national laws,the intraparty laws and regulations have their unique advantages in terms of adjustment methods.The intraparty laws and regulations define the behavior boundaries of party members and party organizations based on obligations.The systems of intraparty laws and regulations are of great significance for the construction of the ruling party,national governance,social governance,and so on.As a legal norm within the party,the intraparty laws and regulations should only be adjusted for intraparty relations and should not be adjusted for external party relations.They are only used to directly adjust three groups of intraparty relations:party members and party members,party members and party organizations,and party organizations and party organizations.However,the special political and legal status of the CPC determines that the adjustment of intraparty laws and regulations on intraparty relations will inevitably affect external party relations,thereby having an indirect adjustment effect on external party relations.The Regulation on CPC’s United Front Work reflects the requirements and characteristics of the adjustment of intraparty laws and regulations.But the problem of adjusting external party relations beyond its scope needs to be corrected in the future institutional construction of intraparty laws and regulations.
